BISMARCK – North Dakota Attorney General Drew Wrigley is supporting a legal effort with eleven other states against WBI Energy.
The dispute centers on whether landowners should receive attorney fees in addition to a 2021 land settlement. WBI used the Natural Gas Act to seize property, and the appellate court ruled that state law can’t mandate attorney fees when federal law is silent.
Landowners argue state law should apply in the absence of clear federal guidance on compensation.
