Majority of Fargo businesses pass alcohol, tobacco compliance checks

(Fargo, ND) -- In the past number of days, the majority of Fargo businesses were able to pass their tobacco and alcohol compliance tests.

Fargo Cass Public Health tells WDAY Radio that Tobacco compliance checks were performed in the city on June 15th In total, 17 businesses were checked and 15 passed, resulting in an 88% compliance rate.

The businesses that failed the Tobacco compliance checks were:

  • Casey’s General Store – 1901 University Dr N - second fail in one year

  • Loaf N’ Jug – 3201 N Broadway - first fail in one year

The first failure in a one-year time period of a Tobacco compliance check includes a possible penalty of one-year probation and a $500 administrative fee. The second failure in a one-year time period could include an up to three-day suspension of the businesses tobacco license and a $500 administrative fee.

As for the alcohol compliance checks, which were held on June 22nd, FCPH says in total 25 businesses were checked and 19 passed, resulting in a 76% compliance rate.

The businesses that failed alcohol compliance checks were:

  •    Blaze Pizza – 1443 42nd St  S – first fail in one year

  • Izumi - 5050 13th Ave S  – second fail in one year

  • Old Broadway – 22 Broadway N – first fail in one year

  • Plaza Azteca - 5505 28th Ave S  – second fail in one year

  • Pho D’licious – 623 NP Ave N – first fail in one year

  • Tailgators Sports Café – 1322 Main Ave – first fail in one year

Penalties for failing alcohol compliance checks for a first offense in a year include a $500 fine, which may be waived if the person serving the alcoholic beverages, as well as the management, have current server training certificates. Server Training will be required within 30 days for any employee or member of management not current with Server Training. There will be no license sanction on a first offense. A second offense can lead to a $750 penalty, with no license sanction penalty.
