Cass County Sheriff clarifies details of 2021 nude photo internal investigation

(Cass County, ND) -- A high ranking county official is working to dispel concerns and rumors after an investigation into a nude photo sent by a Lieutenant of the county sheriff's department was brought to light.

Cass County's Sheriff Jesse Jahner shared the details of the investigation on WDAY's The Jay Thomas Show. Sheriff Jahner says Lieutenant Tommy Ray sent a nude photo to an unnamed deputy, and an investigation concluded Ray sent the material accidentally. Ray received a written reprimand due to a county electronic device policy violation, and did not break any state or federal laws.

"I had a Lieutenant that did some things obviously - or did a thing that was very unprofessional, "said Jahner, "Ray did not deny he used his phone, he admitted to it, he admitted to using it at different times."

The message sent to the unnamed deputy included the inappropriate photo, and the deputy saying "Wrong number." Ray responded with "?" and "Is this coach dirk?" shortly after the deputy's response, later sending "That pic for you Opps sorry that was not suposed to goto you ." and "Give me a call when you are able thanks[.]"

A caller, identified as former Cass County Sheriff's Office employee Cole Thompson, asked Jahner who "Coach Dirk" is, and asked why the investigation did not look into the identity of Dirk. Sheriff Jahner says the investigation's purpose was not to identify Dirk, but rather was to see if the message was intentionally sent to the unnamed deputy. 

"We asked [the deputy] if he wanted it investigated further and what he would want to know, and he said that he wanted to know if the intent was to send it to him, "said Jahner, "We felt through our investigation we answered that question."
