FARGO, N.D. (Valley News Live) – Newly filed court documents are shedding light on what led to a SWAT standoff in Fargo on Tuesday, December 2.

Ben Himle is facing two misdemeanor charges of violation of a domestic violence protection order.

Fargo Police were called to a home at 1305 9th Street North at 9:09 a.m. for a violation of a domestic violence order and preventing arrest. Officers confirmed an order for protection between Himle and the victim, which stated that Himle cannot be within 300 yards of them.

Documents say the victim agreed to exit the home, but Himle refused.

The SWAT team was called because of Himle refusing to exit, and making vague threats about suicide. According to documents, as SWAT was arriving on scene, officers were able to convince Himle to exit the home.

Officers say Himle was placed under arrest without incident and taken to Essentia hospital for medical clearance before being taken to Cass County Jail.

Himle made his initial court appearance on December 4, and his next court appearance is scheduled for February 19, 2026.
