More details on Border Patrol arrest in Fargo

FARGO, N.D. (Valley News Live) – Court documents obtained by Valley News Live have provided more details on the arrest of a man in the country illegally.

Officials were notified by a concerned citizen who reported that Jose Cadena-Velasquez was in the country illegally and had used fraudulent documents to gain employment at Wild Bill’s Saloon in Fargo. They provided a social security card and a lawful permanent resident card that showed a photo of Cadena-Velasquez, but the alien registration number belonged to someone else.

No immigration record was found for Cadena-Velasquez.

Border Patrol Agents conducted surveillance on Cadena-Velasquez’s apartment on August 18 until he left. They then followed his car and conducted a traffic stop at the intersection of 9th Avenue Circle S and 9th Avenue S. They approached the vehicle and identified themselves as border patrol agents.

Court documents say Cadena-Velasquez provided a driver’s license but refused to answer any questions about his legal status. He was ordered to turn off his car, at which point he rolled up his window and locked the door.

Cadena-Velasquez continued to ignore commands until agents broke the driver’s side window with a collapsible baton. The agent grabbed Cadena-Velasquez’s arm as another agent climbed into the back seat to extract him from the vehicle.

Cadena-Velasquez reportedly braced himself within the vehicle by pushing against the steering wheel, attempted to pull away from the agents, and tried to pull his arm free. Cadena-Velasquez then braced himself further into the seat by pushing his feet into the floor and leaned towards the passenger seat.

The report says it took multiple agents to restrain one of Cadena-Velasquez’s arms. Another agent climbed into the passenger seat to grab his right arm, but Cadena-Velasquez pulled the arm away and swung an elbow towards him.

It took four Border Patrol Agents to pull Cadena-Velasquez out of the vehicle. He was then taken to the ground and put into handcuffs before being transported to the Grand Forks Border Patrol Sector Headquarters.

Further investigation confirmed that Cadena-Velasquez had used those fraudulent identification cards on his I-9 form to gain employment. Cadena-Velasquez acknowledged his Miranda Rights, but would not answer questions without an attorney present.
