Local food manufacturer sued for "Texas Pete" name

(Winston-Salem, NC) -- A local hot sauce maker has until November 10th to respond to a lawsuit concerning its name.

A Los Angeles man has filed a class-action lawsuit against T.W. Garner Food Company, which is based in Winston-Salem, North Carolina and makes Texas Pete hot sauce.

The lawsuit alleges the Texas branding the company uses ultimately hurts smaller companies in that state that are trying to maximize the legitimacy of their Texas hot sauce.

The class action suit, filed on behalf of all people in the U.S. who have purchased Texas Pete, asks the court to force the T.W. Garner Food Company to change the name of its product and branding and to pay up.
