Defense strategies in Potter Trial take shape

(Hennepin County, MN) -- Defense strategies are taking shape in the case against former Brooklyn Center Police Officer Kim Potter.

Judge Regina Chu decided that the jury must determine whether Potter's conduct was reckless, or careless. Chu says a finding involving recklessness requires in part "proof of a conscious or intentional act" as defined by a case where a security guard unintentionally fired his gun.  

Potter's defense team says their case plan will focus on their view that Potter didn't commit a conscious act when she says she says she mistook her gun for her taser during the shooting death of Daunte Wright during a traffic stop.

Opening statements for the trial are expected to begin Wednesday.
