(Williston, ND) -- A North Dakota State Lawmaker from Williston was arrested and charged on December 15th after authorities say he refused to submit to a DUI arrest.

Bodycam video of the incident shows Representative Nicolas Rios using homophobic slurs towards two Williston Police Officers. Authorities say he also attempted to use his position as a representative to potentially change the decisions of the responding officers, including saying he would call the North Dakota Attorney General to tell him about the situation.

Rios was charged with DUI charges, having an open container of alcohol in the vehicle, and refusing to submit to a test.
