(BISMARCK, ND) — Seven states, including North Dakota, are facing more difficulty enforcing the Voting Rights Act.
A 2-to-1 ruling from the 8th U.S. Circuit Court of Appeals finds the law cannot be administered from private parties under a separate federal statute. The panel says the law cannot be privately enforceable because the Voting Rights Act does not explicitly name private individuals or groups.
The latest ruling comes out of a North Dakota redistricting lawsuit by two native American tribes.
