ND AG: U.S. Supreme Court striking down Chevron is an “Enormous” development in several lawsuits

BISMARCK, ND — North Dakota Attorney General Drew Wrigley says the U.S. Supreme Court’s decision to overturn a long-standing precedent will fundamentally change several lawsuits currently pending against the Federal Government.

The U.S. Supreme Court ruled 6-3 the Chevron doctrine granted too much power to agencies, saying they often acted beyond the scope of the law that had unclear interpretations. Due to the concerns, the court ruled Chevron was overruled.

Wrigley says this means the courts now have a much larger say in how law is interpreted, instead of government experts.

“Now the bureaucrats don’t run this country,” said Wrigley on WDAY Midday. “They don’t get wide deference when they are interpreting Congressional statute when implementing them as members of the executive branch. They have to adhere to the close guidance of those statutes. Those actions will be judged by courts.”

Speaking on cases the state is bringing to the Federal Government, Wrigley says the overturning of Chevron will dramatically change how the lawsuits are defended in the courtroom.

“It has a lot to say about an enormous number of cases that we have where we are suing the federal government for having their bureaucrats misapply federal law to the detriment of North Dakota,” continued Wrigley.
