(Fargo, ND) -- Former President Donald Trump will remain on the Minnesota primary ballot after the state supreme court on Wednesday dismissed a lawsuit seeking to end his candidacy.
The suit was based on a rarely-used constitutional provision that forbids those who “engaged in insurrection” from holding office.
Had the Minnesota Supreme Court removed Trump from the ballot, the court would have been the first court in history to use Section 3 of the 14th Amendment to prevent a candidate from running for the presidency.
The court did not answer the main argument of the lawsuit, which asserted Trump’s alleged role in the January 6, 2021, demonstration at the U.S. Capitol disqualifies him from the presidency.
The court found that state law allows parties to put whomever they want on the primary ballot.
